Nigeria has taken a significant step towards safeguarding the fundamental rights and freedoms of its citizens, specifically in the area of data privacy and protection.
On Thursday March 20, 2025, Dr. Vincent O. Olatunji, National Commissioner and CEO of the Nigeria Data Protection Commission (NDPC), delivered a landmark address at a press conference and the event marked the issuance of the Nigeria Data Protection Act – General Application and Implementation Directive (NDP Act-GAID), 2025.
Dr. Vincent stressed that this regulatory instrument is a culmination of efforts by the NDPC to implement the Nigeria Data Protection Act, 2023, which was signed into law by President Bola Ahmed Tinubu on June 12, 2023.
He stated that the NDP Act-GAID provides a comprehensive framework for data protection in Nigeria, addressing key areas such as Data Protection Principles, Lawful Bases of Data Processing, Data Subjects’ Rights, and Cross-border Data Transfer.
He added that, it also introduces measures to promote accountability, transparency, and cooperation among stakeholders through an open-door policy which creates an avenue of trusts for lawful use of data towards achieving sustainable development.
One of the notable features of the NDP Act-GAID is the introduction of the Standard Notice to Address Grievance (SNAG), which empowers data subjects to demand remedial action from data controllers and processors. This mechanism is designed to be accessible and automated, making it easier for Nigerians to exercise their rights
He disclosed further that the NDPC has expressed its commitment to implementing the NDP Act-GAID, with full implementation scheduled to commence in September 2025. The Commission has also announced plans to provide guidance notices, carry out capacity-building programs, and solicit feedback from stakeholders.
Overall, the issuance of the NDP Act-GAID represents a significant milestone in Nigeria’s journey towards ensuring the protection of citizens’ data privacy and promoting a culture of accountability and transparency.
